General terms and conditions of business

1. General
1.1
These General Terms and Conditions (GTC) apply to all contracts concluded between ELAMI, based in Switzerland, and the customer via the website www.elami-global.com.
1.2 The shipment of the goods is handled by a partner company in Germany.
2. Conclusion of contract
2.1 The contract is concluded when the provider accepts the customer's order. Acceptance occurs by means of an order confirmation by email.
3. Prices and Payment
3.1
All prices include VAT and exclude shipping costs, unless otherwise stated.
3.2 Payment is made by credit card, PayPal or bank transfer.
3.3 Customers outside Switzerland may be subject to additional taxes and duties, which must be borne by the customer.
3.4 A base price per square meter is charged for the purchase of leather hides. The final billing is based on the actual size of the hides delivered. Please note that the size of the leather hides can vary and therefore can be less or more than the area specified when ordering. If the actual size differs, a subsequent billing or credit note will be issued and the customer will be informed accordingly.
4th delivery
4.1
Delivery will be made to the address provided by the customer.
4.2 Delivery times and costs will be communicated to the customer before the order is completed.
4.3 Shipping is carried out by our partner company in Germany. Any customs fees and import taxes are borne by the customer.
5. Right of withdrawal
5.1
The customer has the right to cancel the contract within 14 days without giving any reason.
5.2 To exercise the right of withdrawal, the Customer must inform the Provider of his decision by means of a clear declaration (e.g. by e-mail or letter).
5.3 The goods will be returned to the address of the partner company in Germany.
6. Warranty
6.1
The statutory warranty rights apply.
6.2 Defects must be reported to the provider immediately.
7. Liability
7.1
The provider is only liable for damages resulting from intentional or grossly negligent conduct.
7.2 Liability for slight negligence is excluded unless it involves a breach of essential contractual obligations.
8. Data Protection
8.1
The provider undertakes to protect the customer’s personal data in accordance with the statutory data protection regulations of Switzerland and the EU.
8.2 Further information on data processing can be found in the privacy policy.
9. Final provisions
9.1
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
9.2 The place of jurisdiction is the registered office of the provider in Switzerland, provided that the customer is a merchant or a legal entity under public law.
